Fleet Command Center — Privacy Policy

Fleet Command Center, LLC (“Fleet Command Center,” “FCC,” “we,” “us,” or “our”) provides a fleet telematics and fleet management platform. This Privacy Policy explains what personal information we collect, how we use and protect it, who we share it with, and the choices and rights you have.

This policy applies across all of our properties and services (together, the “Services”):

  • The fleetcommandcenter.com website and online store (the “Store”);

  • The my.fleetcommandcenter.com customer web application (the “Customer Portal”);

  • The Fleet Command administrator application;

  • The Fleet Driver mobile application;

  • Connected telematics hardware and the cellular connectivity that transmits vehicle data to our platform; and

  • Related communications, support channels, and our blog, The Command Post.

If you do not agree with this policy, please do not use the Services.

1. A note on terms

“Personal information” (also called “personal data”) means information that identifies, relates to, or could reasonably be linked to an identifiable individual. It does not include de-identified, aggregated, or publicly available information.

Where this policy refers to a “Customer,” we mean a business that subscribes to the Services to manage its fleet. Where it refers to a “Driver,” we mean an individual operating a vehicle associated with a Customer’s account. Where it refers to a “Visitor,” we mean someone who browses the Store or interacts with us before becoming a Customer.

2. Our two roles: when we are a “business/controller” vs. a “service provider/processor”

Privacy laws distinguish between an organization that decides why and how personal information is processed (a controller, or business under California law) and one that processes information only on another organization’s behalf and instructions (a processor, or service provider). Our role depends on the data:

  • We act as a business / controller for the personal information of Visitors, prospects, marketing contacts, Store customers, and the account-administrator and billing information of our Customers. This policy governs that processing directly.

  • We act as a service provider / processor for the Personal Information we process on a Customer’s behalf, such as Driver-identity and account information collected through our applications and hardware. In that role the Customer directs the processing; if you are a Driver who wants to access, correct, or delete such information, please contact the Customer (typically your employer), and we will support them in responding.

  • We act as a business / controller for Vehicle Data. We own the Vehicle Data — the telematics, location, diagnostic, trip, and sensor data generated by or collected from vehicles, Drivers, and connected devices through the Services, together with the analytics and outputs derived from it — and we use it to operate, secure, and improve the Services and for our own lawful business purposes, including creating de-identified and aggregated data from it. To the extent Vehicle Data includes personal information, we handle it in accordance with this Privacy Policy and do not sell it. Our ownership and use of Vehicle Data are described in our Master Services Agreement.

3. Information we collect

a. Information you provide to us

  • Account and contact information: name, business name, work email, phone number, job title, and login credentials (passwords are stored only in hashed form).

  • Billing information: billing address and subscription details. Card payments through the Store are processed by our payment processor; we do not store full payment card numbers.

  • Support and communications: the contents of support tickets, emails, chats, and survey or feedback responses.

  • Marketing information: information you submit through forms, demo requests, or newsletter sign-ups.

b. Vehicle and telematics data (Vehicle Data)

Collected from connected hardware installed in or paired with a Customer’s vehicles, and/or from the Fleet Driver app:

  • Vehicle identifiers and status: VIN, make/model/year, odometer, engine and battery metrics, fuel data, and on-board diagnostic (OBD/CAN) data, including diagnostic trouble codes.

  • Location and trip data: GPS position, routes, trips, speed, and movement/idle status.

  • Operational/behavioral data: events such as harsh acceleration, braking, or speeding, and derived driver-performance scores.

This data is associated with a Customer’s account and the vehicles and Drivers the Customer designates.

c. Fleet Driver app information

  • Driver identity and assignment: the name/identifier and vehicle assignment provided by the Customer.

  • Device and app information: device model, operating-system version, app version, language, crash and diagnostic logs, and a push-notification token used to deliver alerts.

  • Locally cached data: the app is offline-first and may store trip and assignment data on the device, syncing to our platform when connectivity is available.

d. Information collected automatically

  • Usage and device data from the Store, Customer Portal, and applications: IP address, browser/device type, pages viewed, referring URLs, session activity, and timestamps.

  • Cookies and similar technologies on the Store and Customer Portal (see Section 8).

e. Information from other sources

We may receive information from authorized resellers or partners who refer you, from connectivity providers that transmit vehicle data, and from publicly available sources used to verify business details or prevent fraud.

4. Current functionality and our approach to surveillance

Fleet Command Center is built to give Customers fleet visibility without unnecessary surveillance of the people who drive. As of the effective date of this policy, the Services do not include, and we do not collect, in-cab or dashboard video, audio recordings, or biometric identifiers, and we do not provide Electronic Logging Device (ELD) or Hours-of-Service monitoring.

We may introduce additional features in the future — for example, optional dashcam or camera integration, or ELD / Hours-of-Service functionality. If we do, any such feature will be enabled at the Customer’s discretion, we will update this policy to describe the additional information collected and how it is used, and we will provide notice where required by law. Where a Customer enables such a feature, that Customer is responsible for providing any notices to, and obtaining any consents from, its Drivers that the law requires.

We do not sell personal information, and we do not share it for cross-context behavioral advertising. Driver-performance scoring in the platform is designed to be transparent to the people it describes.

5. How we use information

We use personal information to:

  • Provide, operate, secure, and maintain the Services and deliver the telematics, mapping, routing, alerting, and reporting features Customers configure;

  • Authenticate users, manage accounts, and enforce account-level and user-level access permissions;

  • Process orders, subscriptions, and billing;

  • Provide customer support and respond to inquiries;

  • Send service and transactional messages (e.g., alerts, security notices, billing notices);

  • Send marketing communications where permitted, which you can opt out of at any time;

  • Monitor, troubleshoot, and improve the Services, including through de-identified and aggregated analytics;

  • Detect, prevent, and investigate fraud, abuse, and security incidents; and

  • Comply with legal obligations and enforce our agreements.

Where we act as a service provider for the Personal Information we process on a Customer’s behalf, we use it only to provide the Services and as the Customer directs. We use the Vehicle Data we own as described in Section 2 and our Master Services Agreement, including to improve the Services and to create de-identified and aggregated data.

6. How we share information

We do not sell personal information. We share it only as follows:

  • Service providers / sub-processors who perform functions on our behalf (hosting, data storage, connectivity, mapping, payment processing, communications, and analytics), under contracts that limit them to using the information solely to provide services to us. See Section 7.

  • With a Customer’s own organization: telematics and Driver data is made available to the authorized administrators of the Customer account it belongs to.

  • Authorized resellers or partners, where you were referred by or purchased through them, consistent with their role.

  • Legal and safety: when reasonably necessary to comply with a subpoena, court order, or other lawful request; to enforce our agreements; or to protect the rights, property, or safety of FCC, our Customers, or the public. Where permitted, we will attempt to notify the affected Customer of a legally compelled disclosure.

  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

  • De-identified and aggregated data: we may use, retain, and disclose data that has been de-identified or aggregated so that it does not identify you or any individual, including data derived from Vehicle Data, for any lawful business purpose. We maintain such data in de-identified form and do not attempt to re-identify it except as permitted by law. This is not a sale of personal information.

7. Sub-processors

We rely on the following categories of providers to deliver the Services. Specific providers may change; current key providers include:

  • Cloud infrastructure, hosting, and storage: Amazon Web Services, Google Cloud, and DigitalOcean.

  • Storefront and payments: Shopify (Store hosting and checkout) and its payment processor(s).

  • Cellular connectivity: Hologram, and, in some cases, manufacturer-provided (embedded/OEM) SIMs, for network transport of vehicle data.

  • Mapping and routing: Google Maps and the Valhalla routing engine.

  • Push notifications: Google Firebase Cloud Messaging (delivery of app notifications only).

8. Cookies and analytics

The Store and Customer Portal use cookies and similar technologies to keep you signed in, remember preferences, secure the Services, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect functionality. Where required by law, we present a cookie banner and honor opt-out preference signals (such as Global Privacy Control) for the categories the law covers.

9. Data retention

We retain personal information for as long as needed to provide the Services, maintain your account, comply with legal and tax obligations, resolve disputes, and enforce our agreements. For the Personal Information we process on a Customer’s behalf (such as Driver-identity and account information), retention is configured by the relevant Customer, and when the Customer relationship ends we delete or return that data in accordance with our agreement, subject to legal retention requirements and routine backup cycles. We own the Vehicle Data and may retain it; in response to a verified deletion request, we anonymize Vehicle Data so that it can no longer reasonably be used to identify any individual rather than deleting it, after which we may keep and use it in de-identified form. We also retain de-identified and aggregated data without time limit.

10. Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit (TLS), encryption of stored data, hashed credentials, token-based authentication, role-based access controls, and a tiered API-key model that separates account-level and user-level access. Access to personal information is limited to personnel with a business need. No method of transmission or storage is perfectly secure; we maintain procedures to respond to suspected incidents and will notify affected parties and regulators where required by law.

11. Where your information is stored and cross-border transfers

The Services are operated primarily from the United States, and personal information of Canadian and U.S. individuals may be stored and processed in the United States and Canada. Information stored in or processed from a country other than your own may be accessible to courts, law enforcement, and authorities in that country under its laws. Where required, we use appropriate safeguards for cross-border transfers.

12. Your privacy rights

United States — California (CCPA/CPRA) and other state privacy laws

Depending on your state, you may have the right to:

  • Know/access the categories and specific pieces of personal information we have collected;

  • Delete personal information we hold about you;

  • Correct inaccurate personal information;

  • Opt out of any “sale” or “sharing” of personal information and of targeted advertising; and

  • Not be discriminated against for exercising your rights.

We do not sell or share personal information as those terms are defined under California law, and we do not process sensitive personal information for purposes that would trigger a right to limit its use. When we honor a deletion request, we may de-identify or anonymize information instead of erasing it where the law permits, including Vehicle Data that we own and retain in de-identified form. To exercise a right, contact us at support@fleetcommandcenter.com. We will verify your request and respond within the timeframes the law requires. You may use an authorized agent where permitted.

Canada — PIPEDA and CASL

We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, following its fair-information principles: accountability, identifying purposes, consent, limiting collection, limiting use and disclosure, accuracy, safeguards, openness, individual access, and challenging compliance. You may withdraw consent (subject to legal or contractual limits), access the personal information we hold about you, and request correction. We obtain consent for commercial electronic messages and honor unsubscribe requests in accordance with CASL. If you are unsatisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.

Drivers and employees

If telematics or app data about you was collected through a Customer (typically your employer), that Customer directs how the Personal Information we process on its behalf is handled, so please send access, correction, or deletion requests to the Customer, and we will assist in fulfilling valid requests. Where we own the underlying Vehicle Data, we respond to a verified deletion request by anonymizing that data so it no longer identifies you, rather than erasing it, as permitted by applicable law.

Marketing opt-out

You can unsubscribe from marketing emails at any time using the link in the message or by contacting us. We may still send you non-promotional service messages about your account.

13. Children’s privacy

The Services are intended for business use and are not directed to children or to individuals under 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us at support@fleetcommandcenter.com and we will take reasonable steps to delete it.

14. Third-party links

The Services may link to third-party sites or services we do not control. Their privacy practices are governed by their own policies, and we encourage you to review them.

15. Changes to this policy

We may update this policy from time to time. We will post the revised version with an updated effective date and, where required, provide additional notice. Your continued use of the Services after an update means you accept the revised policy.
